Welcome to DosHermanos Exclusive Retreats.

By confirming a reservation through this website, the guest (“Guest”) expressly agrees to be bound by the following Terms & Conditions, which constitute a legally binding agreement with DOSHERMANOSEXCLUSIVERETREATS (“Company”, “Host”).

Reservation & Payments

All reservations are subject to availability and confirmation. A reservation is confirmed once payment is received. All bookings are final and non-refundable, regardless of cancellation reason, no-shows, or early departures, except where required by applicable Mexican law.

Luxury Property Use

All properties offered are high-end luxury houses and apartments, furnished with premium materials, custom interior design, and high-value furnishings.

The Guest agrees to:

• Use the property solely for residential lodging purposes.

• Respect the maximum occupancy stated in the reservation.

• Refrain from hosting events, parties, or gatherings unless expressly authorized in writing.

Any misuse, negligence, or unauthorized activity may result in immediate termination of the stay without refund.

Check-In & Check-Out

• Check-in: 3:00 PM

• Check-out: 12:00 PM

Failure to comply with check-out time may result in additional charges.

Guest Responsibility & Damages

The Guest assumes full responsibility for:

• Their conduct and that of all accompanying guests and visitors.

• Any damage, loss, breakage, stains, or excessive wear to the property, furniture, décor, artwork, linens, or amenities.

Given the luxury nature of the properties, repair or replacement costs may be significant. The Guest authorizes the Host to charge the payment method on file for any damages, missing items, excessive cleaning, or rule violations.

Smoking & Pets

• Smoking is strictly prohibited inside all properties.

• Pets are not permitted unless a specific written agreement has been established prior to booking.

Violations may result in additional fees, professional cleaning costs, or termination of the stay without refund.

Security Deposit

A security deposit may be required. The Host reserves the right to withhold or charge additional amounts to cover damages, losses, or violations identified during or after the stay.

Limitation of Liability

To the fullest extent permitted by Mexican law, DOSHERMANOSEXCLUSIVERETREATS shall not be liable for:

• Personal injury, accidents, illness, or death occurring on the premises.

• Loss, theft, or damage to personal belongings.

• Interruptions to utilities, internet, or services beyond the Host’s control.

The Guest assumes all risks associated with their stay.

Right to Terminate Stay

The Host reserves the right to immediately terminate the reservation without refund if:

• House rules are violated

• Damage or misuse of the property occurs

• Occupancy limits are exceeded

• Illegal or disruptive behavior is detected

Governing Law

These Terms & Conditions are governed by the laws of Mexico. Any disputes shall be resolved before the competent courts of the jurisdiction where the property is located.

Acceptance

By completing a reservation, the Guest confirms acceptance of these Terms & Conditions in full.

DAMAGE & LIABILITY WAIVER

DOSHERMANOSEXCLUSIVERETREATS

By confirming a reservation with DOSHERMANOSEXCLUSIVERETREATS (“Company”, “Host”), the guest (“Guest”) acknowledges and agrees to the following Damage & Liability Waiver, which forms an integral part of the rental agreement.

1. Assumption of Responsibility

The Guest expressly acknowledges that the properties offered are luxury residences, furnished with high-end furniture, custom finishes, artwork, designer décor, and premium amenities.

The Guest accepts full financial responsibility for:

• Any damage, breakage, stains, burns, scratches, or misuse of the property or its contents

• Loss or theft of any furniture, décor, appliances, linens, electronics, or accessories

• Damage caused by negligence, misuse, or failure to follow house rules

2. Authorization to Charge for Damages

The Guest hereby authorizes DOSHERMANOSEXCLUSIVERETREATS to:

• Charge the payment method on file

• Deduct from the security deposit (if applicable)

• Pursue additional payment if damages exceed the deposit amount

Charges may include repair, replacement, restoration, professional cleaning, labor, transportation, and administrative costs.

Replacement values shall be based on like-for-like luxury standards, not depreciated values.

3. No Wear-and-Tear Presumption

Due to the luxury nature of the properties, the Guest acknowledges that:

• Certain items are custom-made or imported

• Replacement or repair costs may be substantial

• Damage will not automatically be considered “normal wear and tear”

Final determination of damage classification rests solely with the Host.

4. Liability Waiver & Indemnification

To the fullest extent permitted by Mexican law, the Guest:

• Waives any and all claims against DOSHERMANOSEXCLUSIVERETREATS, property owners, employees, contractors, or affiliates

• Agrees to indemnify and hold harmless the Host from any claims, damages, losses, or expenses arising from:

  • Personal injury or accidents

  • Use of amenities (including pools, terraces, stairs, balconies, or outdoor areas)

  • Acts or omissions of the Guest or accompanying parties

5. Personal Belongings

The Host assumes no responsibility for loss, theft, or damage to personal belongings. The Guest is encouraged to secure valuables and obtain personal travel insurance.

6. Pool, Outdoor & Amenity Use

Use of pools, terraces, balconies, and outdoor areas is entirely at the Guest’s own risk.

• No lifeguard is provided

• Children must be supervised at all times

• The Host assumes no liability for accidents, injuries, or misuse

7. Immediate Termination for Severe Damage

The Host reserves the right to:

• Terminate the stay immediately without refund

• Remove the Guest from the property

• Pursue legal or financial remedies

In cases of severe damage, misuse, or violation of safety rules.

8. Governing Law

This Damage & Liability Waiver shall be governed by and construed in accordance with the laws of Mexico, with jurisdiction in the courts where the property is located.

9. Acceptance

By completing a reservation, the Guest confirms that they:

• Have read and understood this Damage & Liability Waiver

• Accept full responsibility for the property and its contents

• Agree to all charges resulting from damages or violations
